      • richard you can tell me to sod off but how long has it taken to get this far on your claim and was it work or road related????
        reason i ask is i'm fighting a claim myself and since this is the first time i've had to do it i'm in over my head as i don't understand the way the insurance companies and solicitors work????
        I'M ALWAYS IN THE SH'T, IT'S ONLY THE DEPTH THAT VARIES!!!!!!!!

          personally rich i wouldnt ask them for 80k if soliciter thinks 70k then you'll prob get that or a bit more maybe a bit less!!! if it goes to court you could be doing yourself into money or out of!!! meaning the court could decide if you ask for 80k that your being greedy n go against you n you get alot less.
          i hope you get more personally knowing what you've been through.. normally the court will go on what was offered the third time as soliciter normally says dont except the first or second offer but it's game game of swings n roundabouts..
          but then what would i know hope you get more mate like i said you've been through enough already!!!!

              This is a work related accident from 27/07/05.My solicitors are the union solicitors and i think they have done all they can.Mandy probably doesn't think so but like the solicitors have said as i am still able to do some form of work then i won't get a major big payout.
              This claim would of been settled 2-3 years ago if the solicitor was allowed to but i kept taking things one step further with doctors etc until i got a final diagnosis which is permanant nerve damage to the femoral nerve and the sciatic nerve.
              I think you should get a good solicitor involved to help you out.There is no way i could of fought this case myself with the help and support from the solicitors.You will need to have a independant medical report done for yourself and then another independant report for the other side which in my case was about £300 a time and i had 4 done which Networkrail will have to pay.
              Have the other side pleaded liable for the accident in your case.If so then you are part way there and make sure you have it in writting aswell.
              The solicitors i am using are Thompsons and they are in Southampton.They have an office in exeter aswell

              • mines a road accident and i think i got two incompetent police officers, no photos, no accident support unit to work out what happened they even got the registration number wrong twice the vehicle was right in front of them as well so i don't know what they were thinking or i suppose it could have been laurel and hardy reincarnated!!!! then they blame me as i was in and out of consciousness at the scene and couldn't remember anything about the impact they accepted the other guys story without question so now i have to prove otherwise which is taking its toll on me now

                • Hi Rich yes you maybe able to do other work but you can not do what you were doing when you had the accident, when i had my accident it endered up grounded i use to do all the pipe work in the factory. Which was mostly in the roof space, i ended up looking after winding machines when i was in,i was off work for almost 2years countless operations that was in 1975 in the last 10years i have had 9 more operations and i am still going to need more in the future. I ended up on a 9 to 5 job and hated it after 6 months i was struggling only being able to work with one gone hand, i missed out on all the overtime and bonuses so after 6 months i left and have been self empoloyed since.
                  Sorry for going on so much but you have to think of later on in life as you get older your injury will affect you, after 35 years i know i wish i had gone out with the lads the night before and not gone into work and i would not have had my accident. Let them find you a job they say you can do try it for 6months or so compare the wages then sort a settlement out. I settled 1st before takeing the alternative job they offered me and could not tke any more action against them. But things may have changed abit since then anyway good luck on what ever way you deal with it.

                  • The end is now here.I have settled out of court as we are now really in need of the money.If i was able to carry on fighting i would of let it go to court but family comes before any amount of money.
                    I have settled for £65,000 and £10,000 i will have next week and the rest within a month.All cost and dhss payments and sick pay will be payed by networkrail aswell.Its been a long time since i started this thread and now its come to a close.5 years from my accident and just over 4 years the claim has been going.
                    If i hadn't of pushed as much as i did with doctors etc then i wouldn't of got what i have got now in a way of settlement.
                    I would just like to thank everyone who has replied to this thread over the years and the good wishes you have all passed to me
