Although i'm in the office working there is not actually a position vacant for me to work in the office permenant.
My depot manager is working on getting me in the office permenant and if not then i will be out of work.
So things can't get any worse than that for me as i don't know if i will have a job in the next couple of months or so.
The only upside of it all is that i get a ###### good payout to pay my mortgage off and that way i can look for something else
Pants mate - know how you feel - hubbys department has gone out to contract (so not sure he will have a job soon) mine expires as soon as new system is up an running (end of March) and god knows what I am doing then. But hey - you have to stay positive an live for the moment as there is always someone alot worse off than you. Even if it doesn't seem so.

My opinion at the mo is - aaahhh well f@k it, could be dead.
How can I be lost when I've got no where to go

The law says that if you are debilitated due to an accident at work, and your employer accepts some liability, then they either have to moderate your working environment to suit your disability, or find you a job to suit your disability, they cannot kick you out, no matter how big the payout, see your union rep, if they dont know the law they are rubbish reps dont let them bully you or tell you you have to leave, because you dont, write to your lawyer and tell them they are trying to push you out, a terse note from them should put things right, I am a union rep for the CWU, and deal with this stuff all the time, the fact that there isnt a vacancy isnt your problem, they have to find you work, so stick with it!

Oh by the way, get a report from the doctor, or see your own GP to get in writing that your condition will make it difficult to get a job anywhere else, that way your job, and any they find for you will not be subject to contracts running out.

if its their fault you are unemployable by anyone else, then they have to look after you!

Surely the best plan is take the compo, let them kick you out and then do them for unfair dismissal ????

if theres no position available for me then i will be compensated for loss of earnings for the next so many years but its just a shame if i can't carry on working tho.
I have a letter now from the works medical people bupa wellness stating that i am now unfit for normal duties and that i should be accommodated with something else.I'll be talking to my solicitor next week so this will have a big impact on my claim for compensation.3 1/2 years now its been so i better get something worth while.

If i got enough to pay my mortgage then i would be happy plus a bit extra to be able to set up on my own doing something

                      update

had a call from the solicitor today with the 1st offer on my claim,£15000 so i sai no way. This offer was made without the insurers for networkrail knowing that i will never work on track again due to the nerve damage and that it will affect any other manual work i ever do.
It will be the end of April now till i hear of the next offer.I would sooner take it to court and risk losing that 15k than taking that knowing what i've been through and what i am having to cope with in the future

Thats just a teaser to see if you are desperate for the money . I would wait for them to get the full reports and see what the second offer is .
If it's another low one then keep at it some cases can be settled minuets before the case is heard in court.
