My accident update

  • I cant see how they can lay you off on medical grounds. Your inability to perform your duties is down to an accident at work.From what I have read the accident was due to a malfunctioning piece of equipment that they already accept liability for. This being the fact surely they should medicaly retire you.
    This would be separate from any claim for injury you are making. Not instead of.
    I might be talking a complete load of bollix but hopefully have given you an other avenue to explore.

    • thanks Ian.The pay off they are on about is just severance pay,holiday pay and pay in lieu of notice .So basically once they and me have agreed on everything then i will be laid off immediately if i take the money they offer.The compo claim will be seperate but it will have to take into account now that i will be partially disabled now and very limited on what i can do in the future

              you need to take independant advice regarding severence pay, it is a different ball game to compo for injury and losses. Remember they cant sack you and severence HAS to be agreed (you agree to leave for a sum!) the fact that you cannot work or find alternative employment easily points to a high severnce payout, I think your employment is assured and they have a duty to reemploy
              CAB need a visit - dont just leave it to the union, they might be in the situation of 'putting a tick in the box' - as an indication, my ex union refused to chase my claim for unfair dissmissal on medical grounds even though a doctor never examined me! a paper report was accepted by them
              Unions have been known to take the easy way out by giving poor advice.
              Severence and compo are not an either /or if you dont get it in one the other does not allways take that into consideration or include it.
              You need to be looking to Max both
              good luck mate, but before you agree anything even with the union representing you get independant inparcial advice please, if they say the same then you are probably safe.
              YOU CANT DO AN ABOUT FACE ONCE YOU HAVE REACHED AN AGREEMENT!

                                It will be for the loss of earnings through losing my job hopefully but knowing my luck they'll leave it to the insurers to pay up with my compo claim
