        i guess they could use both, depending if they wanted to give you a ticking off, arrest you or have the car off you.
        you can't arrest for a section 59 at all, it's a way of removing a vehicle off the road to stop the use of it escalating!! done a few of these for lads using an inner ring road as a race track!!

        if you were sat in a car park revving the nuts off your car is that liable to cause harrassment/alarm or distress to someone else??

        i know what you're getting at, i don't mind tunned cars as i have had enough of them, but boy racers?!? i shan't say it they annoy me!
        they have no concept that one day they wil hit someone the way they drive and when they do they come out without a problem and the others are alot worse!!

            we dont keep your car in glos you just pay for the privelege of it being towed and stored....

                      its vosa who govern the mots, its legislation is put through parliment and passed by the department of transport not the mechanic, the mechanics follow the guide lines set by vosa to determin wether it passes that mot test or not, if they dont follow it and get found out or they get inspected and found not to be following them they can get struck off or worse get the testing station struck off so what might seem petty or arsey to you is just someones job, same goes if there failing things they shouldnt and found out, they are in the shit.

                        Very little time for MOT testers recently after one garage saying they wouldn't test truck since it was running on veg and diesel. Second garage failed me on the fog light switch not illumating (spelling) that all they could find wrong nothing else no advisorys nothing. (Quick note: I thought this was impressive for a 15 year old truck to through a test and only fail on a bulb) but getting a free retest as long as it is fixed in 24 hours. Which I think is only fair for a bulb that they could have just put in.

                              there is an appeals procedure for failed MOTS...

                              you can appeal a passed MOT too!!... who'd wanna do that??

                                also to add, theres lots of things i might not agree with the test but have to comply, one example is a car can have the central 3/4 width of a tread at 1.6mm, were as a 9 seater mini bus is allowed 1mm at any 3/4 as long as it has visible tread across the width of the tyre, if yer have seen a mini bus trye at 1mm its ludicrous if you ask me but thems the rules.
