Whilst turning in the farmyard where we are currently working 3 or 4 sheepdogs decided they didn't like my motor and proceeded to take bites at the moulded rear mud flaps causing extensive damage (300 quids worth to be precise).My question is should I ask the farmer to pay for this and risk being told to !!!! off?,or should I just go for route 1 and shoot the dogs?Answers on a post card please.

Getting money out of a farmer is like trying to get blood out of a stone.If I shoot the dogs he will most probably be able to claim some kind of subsidy or compensation.On a lighter note where would I be able to buy the moulded plastic mudflap trim from?,tried Milners and Rough Trax,no joy.Last edited by RobD; 15 July 2004, 20:01.Powered by ????

The matter is currently in the hands of the Farmers insurance company (NFU Mutual)damage currently estimated at nearly £300.00 will need new lower rear mudguard on drivers side(mountings also damaged)other side will require filling,both sides need respraying.Powered by ????

The farmer hasn't got a leg to stand on. There's a specific Tort in law called "Rylands & Fletcher" if my memory is still working. It states that if anyone "keeps anything on land which, if it escapes causes damage", the owner is fully responsible. That includes animals, vehicles, etc. There is NO defence to this. The insurance company should pay up without any problem. If they quibble, try that on them (but check with a solicitor first that's it's still valid law as I learn that about 25 years ago).Mike G
