    Have just emailed their agency as follows:

    Dear sirs

    Thankyou for your response to my last email. Unfortunatley the response does not seem to answer any of the questions that I put to VOSA. Within the email you state 'SVA for M1 passenger vehicles has now closed'. Can you please explain in greater detail as to why you cannot provide me with the information.

    In an average year the volume of the combined SVA and ESVA, suggested by VOSA, is in the region of 30-35,000 vehicles. I am not convinced that there is no-one within your agency who is in a position to offer an explanation.

    The Freedom of Information Act 2000 requires disclosure by the Vehicle & Operator Services Agency.

    If you are unable to advice me please can you give me the contact details of the public body/agency who will be able to assist.

      This is your fight and I would be the last to try and deprive you of any fun but you could try hitting them with a direct request under the freedom of information act.
      If you decide to go down that route send a written request by registered mail.
      They cant "file" it and deny recieving it as someone has to sign for it and you can track its delivery to them.
      Im not trying to tell you how to fight your corner (I put you ahead on points) but if I can give you an idea that helps to screw them up I,ll be a happy chappie.

        today recieved a letter from the dvla saying that when i taxed the surf in feb it was under the wrong classification my car was should have been in the reg after 26th march 2006 emissions of 252 and should have been £400. oo


        so i guess its a case of reading through the threads and start sending questions??????

                  Dunno, you'll probably get no further forward what ever you do.

                  My 3rd gen is a 2001 model and it costs the same as my 1991 2nd gen to tax, so it very much depends on which muppet opens the mail at the DVLA.

                    Thank you for your letter of 30th March in response to mine of 26th March. I am sorry that you feel I have not addressed your concerns.

                    Firstly, I should clarify that vehicles that undergo a voluntary approval test are only issued with a Confirmation of Compliance. Vehicles that undergo a Single Vehicle Approval (SVA)/Enhanced Single Vehicle Approval (ESVA) are issued with a Ministers Approval Certificate (MAC) which is an acceptable form of evidence of type approval for UK registration.

                    CO2 emissions are generally established as part of the European Community Whole Vehicle Type Approval (ECWVTA) process – the testing that all new cars must undergo to ensure they conform to European safety and environmental standards. As you know your vehicle did not go through the ECWVTA process and instead, went through the Enhanced Single Vehicle Approval (ESVA) scheme. ESVA is a pre-registration inspection for cars that have been imported from outside the European Union and do not therefore have ECWVTA. CO2 emissions are measured as part of the ESVA test. ESVA is administered by the Vehicle and Operators Services Agency (VOSA) who deal with all enquiries regarding ESVA, including advice on technical issues.

                    All vehicle registration and licensing in the UK, is governed by the Vehicle Excise and Registration Act 1994 (VERA) Currently, under this legislation, cars presented for first registration in the UK on or after 1st March 2001 on the basis of a type approval certificate specifying a CO2 emission figure, attract a rate of duty according to the amount of CO2 emitted and type of fuel used.

                    The licensing and registration system in the UK is entirely separate to that of other countries and operates under its own specific legislation. Currently, the period where a vehicle was registered in another country has no bearing on the vehicles classification when it was first presented for first registration in the UK. Vehicles that have a CO2 emission figure of over 225g/km and are presented for first registration in the UK after 23rd March 2006 fall into Band G of what was previously the seven banded graduated vehicle excise duty (VED) structure and attract VED according to fuel type. Up until 30th April 2009, the rate of VED for vehicles in band G was £400.

                    On 1st May 2009, the number of graduated VED bands was increased from seven to thirteen, in order to provide greater incentives for the uptake of lower-carbon cars. In addition, it was announced in the budget on 22nd April 2009 that a change would be made to the rules relating to how vehicles that are imported into the UK are treated for VED purposes.

                    Under the new thirteen band system, the old band G has been split into two new bands, L and M. However, you will be interested to know that from 1st April 2010, cars such as yours that were registered in the UK after 23rd March 2006, but first registered outside of the UK and emit over 225g/km CO2, will no longer be licensed in bands L or M. These vehicles will be licensed in band K in line with how similar cars that were registered in the UK before 23rd March 2006 will be taxed.

                    Amendments will be made to the vehicle record held at DVLA to ensure that the renewal reminder for a tax disc or SORN (V11) for tax discs being renewed from 1st April 2010 will show the correct rates. The rate of VED for vehicles in a band K from 1st April 2010 will be £245.

                      Thank you for your further enquiry regarding this matter. As explained in my previous e-mail to you, the SVA scheme is ending on the29th April this year for M1 Passenger vehicles. Therefore, there seems little point in providing information historically.

                      However, if you are convinced that historic information is required, then I shall endeavour to provide it. It is also worth pointing out that if you require information under the Freedom of Information Act, then you should approach our Corporate Office, as this is a separate matter, covered by legislation.

                      There is no such thing as an Extended SVA test and as such I am unable to comment further on this matter [I guess this was a typo on my part]. Perhaps you could explain what it is you are referring to?

                      VOSA do not issue Confirmation of Compliance documents, so again, I am unable to comment further on this matter also. I am not in a position to comment on legislation or Ministerial consideration and would suggest that you contact the Department for Transport direct if you wish to pursue these matters further.

                      It does appear that you may not fully understand either the SVA scheme or the processes involved. I have therefore attached two guides which may prove useful.

                      I do hope this information is helpful, but should you have any further questions, please do not hesitate to get in touch.

                        so i wonder if we can get away with the increase they have asked for based on the fact that i was originally charged £225 and the rates have been altered for next year.

                          You've got to laugh!!

                          The tax on my Surf runs out the 31st March and just got the Renewal Reminder. Six months £222.75, 12 months £405.00. After reading the above posts i checked the DirectGov website and yes from the 1st April my Surf moves to Band K at £ 245. Now the reminder tells me my tax disc runs out on 31/03/2010 . I then notice a printed "Warning" THE RATE SHOWN WAS CORRECT AT THE TIME OF PRINTING.HOWEVER A DIFFERENT RATE MAY BE PAYABLE DEPENDING ON WHEN LICENCE IS PURCHASED.!
                          I think i'll be an April Fool and tax my Surf on April 1st and hopefully save £160. I say hopefully because from experience of DVLA its never that easy!!
