    Just so as you Don`t get confused here is the legilation regarding the use of phones in cars

      Does para 2 mean that a passenger in a car can be done if the driver uses a mobile?

          Not sure on that one although I think that a passenger in a car can be done if the driver is drunk and they know - aiding and abbetting or something like that so if plod wants to they probably could.

          Interesting that the rules basically say that you can be done as long as the engine is running - I wonder about making a call in the car park of a service station in the winter with the engine running to keep warm - or stuck in a snow drift by the side of the road like so many people were last winter on the M11 - making a call to tell loved ones that you are OK with the engine running to stop you from dying (mind you I doubt if plod would be out then anyway).

          Best defence is fit a car kit - for £99 from Halfrauds, one that you could fit yourself in less than an hour.

            Correct, you are the responsible party and should be alert, observant, able to give instruction and be in control of all your faculties (including sight and hearing)at all times.

              No. It means that you cannot force the driver of a vehicle to use their phone whilst driving. (I think that this would be an employer/employee situation).

                my firm has just splashed out and bought us all blue tooth phones and ear peices but they are soo uncomportable, i now have to pay out of my own pocket for a bluetooth carkit instead

                        A big Up to the Marketing Director of The Carphone Warehouse who almost did a Gerald Ratner on the radio the other night. He exploded the myth that only bluetooth hands free kits are legal. Something that some of their more unscrupilous competition have been spreading.
                        Apparantly the dangly wire type earpieces with the mic in the lead and the answer button built in are perfectly adequate for us to comply with the law. As long as the phone is fixed down or enclosed within a pocket and you only have to press the button on the earpiece lead to answer, you are OK. Iv'e seen these as cheap as £6.00, so there really is no excuse. No good if you want to make a call but Ok for answering and will tide you over until there are enough pennies in the jar for a fitted kit

                        BTW, I have been hands free since long before mobile phones. I learned an early lesson, when i first got my Amateur Radio Licence, when I got the curly microphone lead wrapped round the steering wheel of my 1971 Volvo and nearly lost control of it. A 30p electret mic insert, a 10p press to make- press to break switch and a mic plug for the rig and I was in business. Can we have a Ham Radio, Power Kiting Winemakers Section?

                            Fine on Phils comments. He and i both have a regard to the safety point. With regards to hands free as a Radio Ham we are exempt from the legislation as we fall into the same catagory as the police as a PTT service. If however we got pulled for having a microphone in our hands they can still do us for not being in full control of the vehicle, so if they dont get us one way they get us the other. The best thing is to do the honurable thing and do a bit of construction or buy a comercial hands free kit for our radios. They range in price from a few pounds to build to £90 for a Heil system.....


                            Just remember its best to do the right thing and be hands free its cheaper in the long run....
