  • Buying Surf in UK?...Dealer Warning!!!

    Anyone in South UK be warned of a dealer JESSE PENFOLD in Cranleigh near Guilford... he is a 'cherry picker'!!!! I bought a surf from him, 6 weeks later my gearbox went, he hadn't paid for the warrantee that came with the vehicle he just gave me some booklet from a warrantee company...I paid just over £2K for the repairs that were necessary to the vehicle...Its partly my fault for falling for his lies but PLEASE NO-ONE buy a car from this man!!!!

    isn't that covered by the sale of goods act aginst major faults?

        It is and you should be looking at getting your money back via the courts.
        Good luck with this as there is no guarantee he will pay up even with a judgement against him or warrants and bailiffs going round.

        I speak from experience here as I am still trying to get £2000 off a scum bag dealer in Rochdale who just refuses to acknowledge any of the court orders or warrants issued...................been going on for over 12 months and has cost me £200+ .........the laws an ass and he knows it the tw*t.

          if you have a serious mechanical failure within the first six months you can demand a repair or replacement vehicle or a full refund that is the law I should know I bought a 2.4 and the head went within two weeks and the sales man tried to fob me off with a load of sh*t saying it was not covered. I got my money back in full.once I read him my rights as a customer he was speechless its the first time I have ever seen a second hand car sales man lost fore words you are covered bye the sales of goods act 1979 also as of the 31st of march 2003 the onus on the dealer to prove the car was of satisfactory quality and if the box has gone after six weeks then it was not of satisfactory quality you can read your rights on the auto trader uk web site look under buying advice its worth reading take him to court if you have to if I was you I would turn his fore court into a gost town that will wake him up it doesn't cost much to print out a load of leaflets on the pc warning people of this con man and if what you print is true and correct ther is nothing he can do about it don't let him get away with it hit him where it hurts in his pocket or his head what ever gives you the most satisfaction good luck

            Hi there, i too have bought a surf from this man about 5-6 weeks ago, drove it home and discovered a leak from the gearbox Luckily it only turned out to be a washer which needed replacing (knock on wood). I still have not recieved any compensation and am still awaiting the registration document. I will be contacting the DVLA shortly and/or trading standards if i dont have any success. PM me if you wish to discuss anything

              Thanks people...you are all completely correct BUT I have tried threatening him with all the above...he offered to repair the vehicle but after an independent and professional inspection of the vehicle after I bought it I discovered there were various things he didn't do that he should have...he also didn't send me my paper work until I went round there and demanded it from him 3 months later...I was not about to give my pride and joy back to this scumbag! I could pursue it through the courts but I'm pretty sure I'll never get the money from him as I'm by no means the only person looking for compensation from him. Live and learn!!

                Persue the g*t through the small claims court. I think, allowing for inflation, that £2000 is classed as a small claim.
                It's only a hobby!

                  nearly bought off him the other week. phoned him and asked if he had any 3.0l ltds in stock, told me he had, drove 50 miles the same day to find out they hadnt, so looked at a 3.0l he told me it had just had a full service, looked underneath it to find they exhaust corroded through and snapped clean off with rear suspension leaking. He told me he'd had it serviced off site by a toyota expert, so asked to see service receipt and he couldnt find one ...... so i walked away.

                    Why not bring this person to the attention of trading standards Im sure they would like to get people like this off the trade....
