    We'll see how it goes. My mum did eventually say okay settle for 50/50 (even though she wasnt in the wrong) but just to get out of the stress of going to court. They took the offer and said, no 60/40 after they initially pushed for a 50/50 settlement. So she's decided to go to court as theyre taking the mick. Then suddenly another witness popped up who wasnt there and they want 100%.
    The annoying thing is the solicitors are taking the stance of "oh just allow them to blame you and we'll pay out and that will be the end of it"

      Theyre (the other party involved) trying to highlight the fact my mum is disabled. Saying he "doesnt have a disability that affects his driving".

      Isn't this discriminatory? Her disability doesn't affect her driving any way and I'm not sure how they found that information out.

        Court case lost.

        Another lesson learnt by Tony, if you call false witnesses into a courtroom you can win a court case by lying!

        Theft and lying is obviously the way forward in life. How comes this is not teached to people at a young age?

                Now I know! I had a thought earlier, would I use taut or taught. I really couldnt decide then it popped into my head that I would go for the middle one. Then post it within some kind of rough sentence on the Hilux Forum and Albannach would provide a correction.

                      That would be taut. Unless it was a contractual dispute, then it's tort, but a lemon flavoured tart could be described as a torté.

                        Some kind of unbearable legal pedant might point out that tort would be a breach of a non-contractual (i.e. common law) wrong. But fortunately there aren't any of those round here...

                              This isnt the first time this sort of thing has happened though. A few years ago a foreign driver with no license but somehow had insurance stalled off the lights and rolled into the front of my mum. Eventually giving details after refusing, the police discovered he shouldnt have been on the road and so was at fault under these circumstances regardless of rolling into my mum (looking like she hit him) the motability insurers repaired his car any way and made her pay the £75 excess to have her car repaired..

                              This happened to me some years ago in the winter, packed snow on the road so very slippery approaching a corner on housing estate I saw a rover approaching quite fast as there were cars parked on the other side of the road from me I thought its not going to be able to stop, so I pulled of the road onto a wide verge my drivers side rear was just coming up the kerb when she ran into me smashing in the rear wheel arch and badly denting the rear door, we exchanged the relevent documents (no people were anywhere on the road or paths) and I notified my insurance a company called DAS taking up the collision details on my behalf,so pretty straight forward I thought, but no, three months later I receive her version of events I was driving far to fast for the conditions (actually in second gear doing about 15mph) we hit head on smashing her front bumper ( side damage to my car?) but now comes the killer she had two witnesses that I ran into her, (no one anywhere to be seen). Also she actually lived in the road this happened in. DAS dropped the claim like a hot brick without investigating further, I had to write off a lovely black 3 ltr laguna for a pitance from the insurance company, so believe me I know what you are going through.
