Yes, the rules can be unfair. One of the best green lanes I've ever driven (the central part of Sarn Helen) was closed a couple of years back during the insidious creep of rights of way closures. Unless we are careful, and absolutely beyond reproach in the eyes of the authorities and the general public, we are, to put it bluntly - fcuked.
