  • Off Roading Responsibilities

    If you organise an off roading day out, say for people on the forum, but not for any financial gain, could you be held responsible if you took people off road and they got hurt? Or if their truck got damaged?

    Nothing ridiculously dangerous mind, like somewhere where no sensible person would drive, just a run of the mill green lane, light off road route.

    Probably these days! lol, if its any consolation they wouldn't be welcome back here if they personally sued you after arranging a trip.

    Byways are legal roads, any accident on them is covered by your normal insurance, so as long as you make sure everyone is propely legal then nothing can come back on you.

      Cheers Tony. It's a funny old world these days, plus I'm a cynical barsteward!

      I've always been out with someone else leading the group but it looks like me this time as I now know quite a few local routes. I certainly wouldn't want to put people off who have been asking if they could come along.

        Get everyone who attends to sign a simple disclaimer absolving you of any responsibility and stating they are there for a drive but not an organised one.

            This is whats done at the off road place we go to down here.As the land owner is giving us somewhere to play he makes sure we all sign in and state he's not responsible for damage or injury on his property while off roading

              If anyone gets injured off roading here, we finish them off with a hand gun. Always carry a shovel.

                  Jim as as Boats and byways as Tony has pointed out require tax and insurance , BUT not all insurance companies will honour any use of a byway of boat.

                  For example Direct line will not insure you if you use you vehicle off road

                  It is a nightmare to sort , up untill now i have not thought about it but in future runs there will be a disclaimer put in the thread and i will check to see if if more is needed , The navex stuff i have just been a set of map corordinates and a brief bit of info on rescue recovery and the use of routes ....

                    I should imagine that if the unthinkable happened, they would come after the organiser/leader.

                      A Plan will cover us even if we total it at an offroad site, we asked, as long as you're not competing then they are happy.

                        Not all will though so it's best to check the small print , as for organising for aa paid event Public Liabality would be required , not just for the attendiees but for the public that was effected by the route , I would check on the MUDCLUB website as they can be quite Anal about offroading as well as the GLASS website as they lay down the guidelines

                          An interesting point I suppose, but doesnt it just suck all the joy out of life. Just how long before we all carry a sheaf of disclaimers every time we go out, just in case we give someone directions to the bus stop etc and they trip on the way. Things like this depress me. Its a sad day when someone has to live in fear when trying to do something good.

                              Disclaimers mean nothing in a court of law unfortunately, if you organise a day out you are no more liable than if you flashed your lights to let someone though on a normal road!
                              Nissan Patrol for on-road, and a Land-Rover 110 shed for off-road :-)
