In this specific scenario, i.e: greenlaning, they complain about the bobblehats, yet it's no sodding wonder they get away with complaining like they do. People with that attitude may just as well chuck petrol on the T.H's arguments, for they are definitely giving them plenty of fuel.

as it stands at the moment i dont think any of us will be green laning in 5 years time the way support for the anti mob is growing. and in 10 years it'll probably be banned from private properties allowing it too in the name of the environment.

Someone posted a thread about a P&P site in Wales being threatened with closure due to local pressure, and there was a story about one of the bigger ones closing in TOR this month. Lanes are being TRO'd left right and centre, and tax on 4x4s is going through the roof. 'They' dont want us, and 'they' will get their way sooner or later.

as long as people realise that when greenlaning its THEIR responsibility to get the right lanes and stay off private property. i understand that mistakes get made and that the attitude of landowners can make a situation worse. but, at the end of the day, this is our hobby, and its in our hands how much good/bad press we give ourselves with our actions.

i don't think what i said in the other thread was really out of line...did i misread this comment. coz to me it reads like you're condoning irresponsible behaviour to the extreme if someone was to disagree with your opinion.

i may be ranting a bit but the reason is valid. attitudes from the minority of 4x4 owners like this is what fecks it up for the rest of us.

once again, to make it clear - i'm not going on about this specific occasion as i've said before, scorpion won't cock up again after this experience, but he also sympathised with the farmers position and he didn't slag the guy off for having the right to keep his PRIVATE PROPERTY PRIVATE - whereas you and george think you have the right to access his land.

Well, to clarify, if you do not take reasonable steps to prevent people from accessing your property, you are indeed responsible for their safety.

Equally, you cannot prosecute someone for trespassing. You can prosecute them for not leaving when asked to, and you can prosecute them for breaking an injunction that prevents them from trespassing in future.

A sign saying 'private' is not enough to prevent you from being responsible for people's safety on its own, but would certainly be a consideration. If you want to prevent people from creating a right of way (which in itself needs to go somewhere else public) over your land, you need to actively prevent access for a long period of time. This is normally achieved with a chain or gate and a correctly worded sign stating that it's not a right of way and is private land. This still doesn't prevent people from being able to access it, but does stop it from ever legally becoming a right of way.
