No, funnly enough the wheels can stick out but they can't rub on the wheel arch at all - the police can nick you for it though
Why not make it (wheels protruding) a MOT fail if you can be nicked for it? I am only aware it is an issue because a mate of mine is selling some wheels and my other mate turned them down because they stuck out 1" or so on his truck, and he believed he would fail his MOT for it.
An MOT is just a check on that day that the car is mechanically safe to use on the road.
The construction and use laws are the laws on what you can actually use on the road legally, and nothing to do with the MOT. Sticky out wheels on anything that can do over 30 mph (or something like that, it lets tractors and the such off having to comply) are what you'll fall foul of.

It's nothing to do with the mot or the tyres fouling the arches.The tread of the tyres has to have some form of fixed arch over them to prevent muck and spray being thrown up from the road while driving.Also it's meant to stop stupid people from being caught by the tyres and the arches should prevent this.
How do i know?The coppers that pulled me in Lucifer had the regs book and quoted it to me
