insurance question

on saturday night some bird wanted something out of my car (which was parked at the pub)... she took the keys and went and got the car.

on her return she crashed into the back of my mates van and cracked the bumper...

wasn't too bothered, but now i've changed my mind and decided to get her to replace my bumper!!!...

the question is... if i go to police and report her for driving with no insurance, will i get done for it being in my car??... if she is insured do i count as a 3rd party?... or do i just sue her ass... (for about £275!!... hehehe!!)

Hmmm, tricky one. First off you are not the third party, your mate is. She is only insured if you gave her permission to drive it, therfore you can't do s!*t unless you report her for steeling it- with the keys!!!

By the way who are you insured with as mine needs renewing (starting) and i am awaiting delivery of my smurf from TonyN soon with new engine.

did you say she could drive it .. if ans is no she is takeing without owners consent .. ring the police .. even if on a pub carpark it is a public place . as it is a right of way to joe public

ur best bet is ask her to pay up or ur tellin the police and will take her to county court for small claims " i think itll cost u £ 30 ".
that n normally do it " as long as shes not a total nutter shell pay way before these actions

is she fully comprehinsive? if so shell be covered to drive n e motor at third party risks " ie cant claim for ur damage but could only if she hit a person".....
but only IF U DID give her permision to drive ur surf....

if U DIDNT give her permision to drive ur surf ,itlls illegal , no matter what insurance she got.. its theft even if u gave her the keys to enter ur surf.
and she could go to prison for it ... but i doubt it ..

In the eyes of the law, if she's not insured then you shouldn't have given her the keys.

I doubt the police would be interested in a non-injury (off-highway, low value, no drunks involved) accident anyway.

£15 for a letter from a solicitor stating that she "is liable for the damage and legal steps will be taken to recover such" is worth a punt.

i say u should leave it and swallow ur pride, learn from this lesson and don't give ur keys to strange women or just ask her 2 pay it or just go half each as ur in the wrong just as much as her for giving her the keys.
if it was me that damaged ur car i would hav offer 2 pay 4 the damage anyway so if she's a decent person u'l hav no probs.
