It could well be a genuine mistake. Sometime you press so many buttons and you press it before you reliased it was what it for.

Ebay has a good forum for people to post for advice. The general consenses are that you CAN'T force someone to complete an tranaction they don't wanna, even tho the bis is socalled legally binding. In reality, it's easier to file for a non payment report and get your fees back when you relist the item.

After that, it's up to you whether you believe him or not. If you do, do nothing, if you don't give him a -ve for time wasting.

I have never sold anything on ebay , although I have tried . Been messed about by bidders and no payers .

Anyone want a set of 6 x Triumph TR8 Revolution wheels with new tyres . No , 20 people did on ebay at one point then no sale .

3 off 12" Wolfrace alloys for Austin Mini , winning bidder failed to pay .

            Cosworth BDA waterpump , £149 +VAT new . I'll take 1/2 price .

            And more .....................

I know the buy it now button opens up to a new page asking for confirmation, but if he thought he had pressed the button thinking it was to bid and the brain takes over and automatically went thru the motion of 'clicking'. Now how many of you have bid on Ebay? you look at your keyboard punching in 9.99 for your max bid on tube of copper grease, you press enter, and it leads to a new page asking you to confirm you intend to bid 9 99 on this item and it is legally binding. You click on bid again..... only then you realised the . is missing and you have bid 999 instead for a tube of copper grease.

Do you sit there and hope no one is mad enough to bid you all the way or you can email the seller telling him you'd made a mistake and 'beg' him to cancel your bid (which incidentally is what Ebay advice ppl to do if they make a mistake on bid)?

End of the day, it's your call, if you think he's time wasting report him as non payment and give him a -ve. Either way you get your money back.

              P.S Who's Dave?
